Media Copyright Policies

The Media Services Department of CSB/SJU follows the Code of Conduct for members of the Consortium of College and University Media Centers with regard to copyright matters.

"Whereas, we believe that a balance must exist between the rights of the producers and distributors of the works which we collect and disseminate and the privileges of ourselves and our patrons who benefit from their display; and Whereas, we understand that if the owners of audiovisual works are denied their legal right to actual and potential revenues that may be derived from their works, the net effect will be a decline in the production of audiovisual materials, and whereas, we consider infractions of copyright law to be equivalent to acts of theft."

  1. Off-air recording that departments own and have been retained longer than the 45 days free-use period are considered illegal. See below for details concerning the 45 day period.
  2. The Media Center shall not put illegal off-air recordings on reserve in the library.
  3. The Media Center shall not make duplicate copies of illegal off-air recordings.
  4. The Media Center shall not alter off-air programs. Excerpts of programs can be used in class provided the recorded program is not altered from its original content.
  5. Off-air recordings shall not be added to the libraries collection without permission from the copyright owner.
  6. The Media Center shall not duplicate copyrighted tapes.
  7. Some media owned video cassettes have public performance rights; many, however, do not. Those that are labeled for "home use only" may be used in a face to face teaching situation.
  8. Groups or clubs may not use "home use only" videos in a public performance setting. They must rent videos from sources that grant public performance rights.

Off-air recordings may be used once by individual instructors in the course of relevant teaching activities, and repeated only once when instructional reinforcement is necessary, in classrooms and similar places devoted to instruction within a single building, cluster or campus, as well as in the homes of students receiving formalized home instruction, during the first 10 consecutive school days in the 45 calendar day retention period. After the first 10 consecutive school days, off-air recordings may be used up to the end of the 45 day retention period only for instructor-evaluator purposes, i.e., to determine whether or not to include broadcast program in the teaching curriculum, and may not be used in the institution for student exhibition or any other non-evaluative purpose without authorization.

Media Material Purchasing Policies

Suggestions for selecting AV materials for classroom support are as follows:

Faculty members are encouraged to make requests for the purchase of media software through their department bibliographers. Approved requests are then forwarded to the library and the following issues are weighed before the purchase is initiated.

  1. Does the amount of anticipated use warrant the purchase?
  2. Is ILL of the item an option?
  3. Is the cost of the software within reasonable limits?
  4. How much money has the department already spent on software?
  5. Does the department wish to contribute funds toward the purchase of the software?
  6. Could the item be used by other departments?

If the decision is made to purchase, a preview copy will be requested whenever possible. The faculty member who initiated the request will then be asked to view or audit the item to assess its quality and content.

AV for liberal arts support: Faculty members and other members of the CSB/SJU community are also encouraged to submit requests for software items which will support self-directed learning. These need not be channeled through a department bibliographer, although some of the same issues as mentioned above will be considered before purchase is initiated.

AV for recreational viewing: In an effort to keep the feature and foreign film collection up to date outstanding and/or award winning titles will be added to the collection annually.

Media collection weeding policy: The software collection at CSB and SJU will be weeded periodically. Weeding usually takes place when lack of space for growth of the software collection occurs. At that time items are removed from the shelves, and forwarded to the departments concerned for their determination of whether or not the information contained in the software is still current enough to warrant keeping.

Media Production

At the College of St. Benedict, S. Janelle Sietsema is responsible for media production which includes mounting and laminating of materials. Editing and duplicating of DVD’s and videocassettes is handled by Adam Konczewski.

At St. John's University, Adam Bauer is responsible for the duplication of videotapes, the transfer of tapes from PAL to NTSC, and videotape editing. DVD, CD, Audio tape, and VHS duplication can be done in the libraries with several self-service stations available for use.

Classroom Resources

At St. John's University one must call Burdette Miller-Lehn at 2117 to make arrangements to use media in their classrooms, and at the College of St. Benedict one can contact S. Janelle Sietsema at 5609. St. Ben’s and St. John's also have overheads and screens TVs/VCRs and DVD players located permanently in most classrooms. For information about IT Service's classroom technology options, consult their Classroom Technology page.

There are a few rooms at St. John's which may be used for video and computer projection in a theater style setting to make arrangements to use them call Burdette Miller-Lehn at 2117. The rooms are AVI (in Alcuin Library) which seats 150, AV2 (in Alcuin Library) which seats 60, The Eila Siren Perlmutter Little Theatre--Q346 (in the quad) which seats 50. The Nickelodeon (in Alcuin Library) seats 20 and can be used to view videos and DVDs. During the summer ALL AV rooms except the Nickelodeon are scheduled through the Special Events office @2240.

Video Teleconferencing

We have video teleconferencing capabilities in AVI (in Alcuin Library), the Alumni Lounge, Q346 and Q264 (in the quadrangle building). There are phone lines in these rooms, which means that if needed a video teleconference would have interactive audio capability. A teleconference could also be broadcast in the Art Center Lecture Hall, but would not have the interactive audio capability. To make arrangements to broadcast a teleconference please contact Dan Sis.
